Historical Perspective

Since the early 1950's, the developmental services system has come a long way in the state of California and the nation.

While individuals with developmental disabilities previously faced isolation, segregation and lack of individual freedoms, they now have many more opportunities available today.

Historical Timeline and Documentary

The historical timeline called "Reaffirming the Commitment...Realizing the Vision - 40th Anniversary Edition of the History of the Regional Centers in California" and a documentary on the development of regional centers entitled "We're Here to Speak for Justice," chart the course of the developmental services system through the last 50 or so years. A sequel to “We’re Here to Speak for Justice” was released in 2006 called “How Far We’ve Come.” The film explores the regional centers’ many accomplishments and their impact on the lives of individuals with developmental disabilities and their families.

We invite you to use these tools to learn more about how legislation has evolved in the United States and in California, and track the development of the service system as we know it.

The journey, propelled by parent-professional partnerships, is a fascinating one and leaves us thinking towards the future and the exciting possibilities it holds for our community.

 

The Lanterman Developmental Disabilities Services Act

The Lanterman Developmental Disabilities Services Act, known as the "Lanterman Act,” is an important piece of legislation that was passed in 1969. This is the California law that says people with developmental disabilities and their families have a right to get the services and supports they need to live like people without disabilities.

The Lanterman Act outlines the rights of individuals with developmental disabilities and their families, how the regional centers and service providers can help these individuals, what services and supports they can obtain,  how to use the individualized program plan to get needed services, what to do when someone violates the Lanterman Act, and how to improve the system.

미국 캘리포니아주의 경우, 주정부에서 지난 1973년 발달장애인을 위한 지원사항을 구체적으로 명시한 랜터만 법률(Lnterman Act)을 제정해

 1977년부터 시행하고 있는 것으로 전해졌다.

미국 스탠포드대학교 교육심리학 박사이자 컨지역센터(Kern Regional Center)의 대표인 미칼 찰스 클락(Michal Charles Clark)씨는

전국장애인부모연대가 지난 2일 사회복지공동모금회 대강당에서 개최한 ‘발달장애인 지역사회 지원체계 구축을 위한 한·미 국제포럼’에서

 한국의 장애인부모들에게 랜터만 법률에 대해 소개했다.

주정부 차원의 발달장애인 지원법…발달장애인 권리 구체적으로 명시

캘리포니아주에서 랜터만 법률을 제정한 것은

연방정부의 발달장애인 지원법 DDAct가 발달장애인 권리 보호 기구 운영 등 발달장애인 지원과 관련한 최소한의 사항만 규정하고 있고,

 발달장애인 개인 및 가족을 위한 구체적인 지원에 대해서는 규정하지 않고 있기 때문이다.
주정부 차원에서 발달장애인에 대한 지원체계를 마련해야 한다고 생각한 장애인 부모들은

1973년 캘리포니아주의 하원의원이자 국회예산담당자였던 랜터만(Frank D. Lanterman)의원에게

 발달장애인을 위한 별도의 법을 만들어줄 것을 요청했다.
클락 박사에 따르면, 당시 장애인 부모들은 랜터만 의원을 만나기 위해

그가 자주 가는 술집에 잠복했다가 귀가하는 랜터만 의원을 엘리베이터에서 둘러싸고 ‘우리의 이야기를 들어달라’고 간청했다고 한다.
이를 계기로 랜터만 의원은 발달장애인을 둔 부모와 가족들의 어려움에 대해서 알게 됐고,

 주정부가 시행해야 할 발달장애인 지원에 대해 구체적으로 명시한 랜터만 법률을 의회에 제안했다.

이렇게 해서 주 단위로는 처음으로 발달장애인과 그 가족을 지원하는 법률이 제정됐다.

랜터만 법률의 주요내용을 보면,

▲발달장애인의 권리와 주정부·지역센터·서비스제공기관의 임무

▲발달장애인을 위한 정책 협의 및 감시기구 설치·운영 절차

▲발달장애인을 위한 서비스의 종류와 제공절차·원칙 및

 발달장애인이 필요로 하는 서비스를 제공받지 못할 경우 이의신청 절차 등에 대해 규정하고 있다.

특히 발달장애인의 권리에 대해서는 스스로 원하는 옷을 입을 권리, 친구들을 만날 권리, 원치 않는 치료를 거부할 권리,

종교를 가질 권리 등 다양한 권리를 명시화 했으며,

발달장애인이 이용하는 모든 시설에서 이 권리 목록을 포스터로 만들어 벽에 부착하도록 규정했다.

클락 박사는 “랜터만 법률은 그 제정 및 집행 과정에서 발달장애인과 그 부모들의 목소리가 적극적으로 반영된 법률”이라며

 “지금까지도 많은 발달장애인과 부모들이 이 법률의 실효성을 높이기 위한 활동을 전개하고 있다”고 전했다.
